Data Processing Addendum
This Data Processing Addendum describes how AnyChat processes personal data on behalf of customers when providing the Services. This page is for informational purposes and does not replace or override your signed agreement with AnyChat.
1. Scope
This DPA applies when AnyChat processes personal data as a processor for a customer acting as controller, or as a sub-processor acting on behalf of another processor.
2. Roles of the Parties
- Customer: determines the purposes and means of processing personal data submitted to the Services.
- AnyChat: processes personal data only on documented instructions from the customer, unless otherwise required by law.
3. Processing Details
Processing may include collection, storage, organization, transmission, and deletion of personal data in order to provide messaging, support, automation, analytics, and related platform features.
Categories of data may include identifiers, contact details, communication content, metadata, and technical usage data as provided by customers or generated through use of the Services.
4. Confidentiality and Security
AnyChat maintains administrative, technical, and organizational safeguards designed to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure.
5. Sub-processors
AnyChat may engage sub-processors to support delivery of the Services (for example, cloud hosting, payment processing, and infrastructure providers). AnyChat remains responsible for sub-processor performance as required under applicable law.
6. International Transfers
Where personal data is transferred internationally, AnyChat uses recognized transfer mechanisms, such as contractual safeguards, where required by applicable data protection law.
7. Assistance and Data Subject Rights
Taking into account the nature of processing, AnyChat provides reasonable assistance so customers can respond to requests related to access, deletion, correction, restriction, portability, and objection rights.
8. Incident Notification
AnyChat will notify customers without undue delay after becoming aware of a confirmed personal data breach affecting customer data processed under this DPA.
9. Return or Deletion
Upon termination of Services and subject to applicable law, AnyChat will delete or return personal data in accordance with contractual terms and documented customer instructions.
